An agreement covering the transition of rights to use the components of the PROMOTIC software (further refered to as Product), between the User and the MICROSYS, spol. s r.o., Tavičská 845/21, 70300 Ostrava 3 - Vítkovice company (further referred to as Provider).
A) Commercial PROMOTIC software usage
Licence agreement for commercial usage of the PROMOTIC software, i.e. the mode, when the software is used on the basis of commercial licence provided by the MICROSYS, spol. s r.o. company in the form of unique HW Key or software key.
The text listed below is included in the printed licence agreement that the User of the PROMOTIC system obtains when purchasing the
PROMOTIC development environment:
Licence agreement. The PROMOTIC software is protected of the
copyright laws and international copyright agreements. The Licence provider has the exclusive authority to handle the software. The product is defined as the
software, media, licence and the documentation in electronic form.
Licence grant. The User can install and operate one copy of the Product. If this agreement is a part of a network licence or a school version, then the User can install and operate the appropriate number of Product copies.
Rights and commitments of the User:
- The User commits himself to operate the Product only in his organization and not to make it available, rent or lend to any third party, with the exception of runtime environment, that can be operated also by third party providing that the corresponding
Licences for PROMOTIC runtime environment is purchased from the licence Provider.
- The User commits himself not to modify the PROMOTIC software and execute no backwards analysis, decompilations or conversions from the machine code.
- The User must not lease or lend the Product.
- The User can delegate (only with the acceptance of the licence Provider) all his rights to the PROMOTIC development environment arising from this agreement, providing that the new licence holder agrees with the terms of this agreement.
Rights and commitments licence Provider:
- The licence Provider grants 2-years guarantee for the Product for the registered Users, starting from the date of acceptance, providing that the Product is used in compliance with the documentation. The guarantee refers to the fact that the Product is able to provide the functionality according to the documentation. The guarantee does not cover any malfunctions caused by an unauthorized interference of the User with the Product.
- The licence provider commits himself to fix or exchange the Product that does not meet the terms of the guarantee. The licence provider holds no responsibility for any possible damages resulting from the usage of the Product.
- The licence provider has the right to withdraw the agreement if the User violates the terms of this agreement.
B) Free PROMOTIC software usage
Licence agreement for free usage of the PROMOTIC software, i.e. the mode, when the software is used on the basis of freeware licence (
PmFree) with no binding to any HW Key or SW Key.
Licence agreement. The PROMOTIC software is protected of the
copyright laws and international copyright agreements. The Licence provider has the exclusive authority to handle the software.
Licence grant. The User can install and run arbitrary number of copies of the PROMOTIC SCADA system in freeware mode (
PmFree). The User is permitted to distribute freely the freeware PROMOTIC installation file.
Rights and commitments of the User:
- The User commits himself not to modify the PROMOTIC software and execute no backwards analysis, decompilations or conversions from the machine code.
Rights and commitments licence Provider:
- The licence Provider does not provide any guarantees and holds no responsibility for any possible damages resulting from the usage of the PROMOTIC software running in the
PmFree mode.
BY INSTALLATION, COPYING OR ANOTHER USAGE OF THE PRODUCT YOU CONFIRM YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT.
